No, there is no need to upload the image again. If the OTRS permission process is successful the image will be restored by an admin here on Commons. And yes your first email was sent to the English Wikipedia queue. Your second email was sent to the correct email address: permissions-commons@wikimedia.org. The OTRS queue is long at the present time but it will get processed. --Captain-tucker (talk) 09:58, 10 January 2012 (UTC)

Dez 09 2011 i sent a request to permissions-commons@wikimedia.org regarding the following images.

I have been trying to get OTRS stamps on a series of images that were uploaded in May, along with OTRS posts. I have posted on this repeatedly, and received exactly zero advice on how to move this forward. Instead, I received a series of what were essentially form letters pointing out things I had already done.

Today I received an email from yet another new person (it appears to have been sent on the 12th, I got it today). This message was once again vague on describing what the *actual problem is*. Actually it doesn't say there is any problem at all, just some suggestions. The images remain deleted.

I have no idea how to move this forward.

For those of you who might be in a position to actually do something about this, let me briefly outline the basic timeline:

- I started a series of major articles on historically important ski equipment, including the Look Nevada, Spademan, Burt and Marker bindings, Head Standard skis, and Lange boots

- I went to an online forum called EpicSki where I knew there were some amazing collections of old equipment. In particular, "Rossi Smash" (this is not a typical "handle", it is the name that appears on his ski passes) has a collection that would put any museum to shame

- Rossi and the other user forwarded me a number of images to use in the articles, using the forum software's internal email functions. At the time, they were quite excited to see their stuff go up.

- They also sent me the releases using the same function. I forwarded these. They were rejected because they couldn't be tracked back.

- I asked both for releases to be emailed to my "real world" email box, which they did. I forwarded these to OTRS.

- One of these was rejected because it was from "Rossi Smash". He re-sent it using his real name.

And that was that. The images were never tagged with the OTRS notice, there was no attempt to inform me of any problems either in my email or on my real wiki talk page. They just disappeared, and I only found out when one of the photographers complained. So then…

- in November I posted looking for help on what was wrong, and the images were restored. I re-posted the OTRS emails.

- I also posted here looking for any help on how to fix any problems. I received zero responses.

- The images were again deleted with no notice or warning.

- I get an email from OTRS saying, well, nothing.

And here we are.

Hi, it is not necessary to undelete the image right now. When the ticket is reviewed the OTRS agent can ask an undeletion or do this themselves. It is also not necessary to fysically sign the email. It is however necessary to state who you are and or represent, and we need to be able to confirm this. The easiest way is to send an email from an adres publicly know to be yours or obviously belonging to you. The email needs to come from the copyright holder of the images. The permission comes from the copyright holder ittf.com? This would be good, because in the past we had no luck in contacting ittf to ask them, if their website permission includes unrestricted use, i.e. modification of the photos. --Martin H. (talk) 22:16, 15 January 2012 (UTC)

The email did not come from ittf.com, but from the uploader himself. The uploader mentioned that the copyright notice is given in the source website and that was accepted by the volunteer who handled the ticket. --Sreejith K (talk) 11:16, 17 January 2012 (UTC)

Hello everyone,

I'm a teacher, living in Vienna, Austria. I'm currently working on teaching materials on portrait-art and I would like to include Grand Wood's American Gothic into this material - not without showing the actual picture. I'm not sure it's the right way if I ask here in this forum if I am allowed to do so. Basically I would like to use the picture in the handout that I'll give to my students (and also this handout will be stored in our online learning-platform). Can anyone tell me if that would be ok.

questionable ticket and OTRS-user

Yesterday Superzerocool (talk · contribs) added[1] alleged OTRS-ticket #6424498 to File:VictorHurtado-LaSublevacion-Sevilla1.jpg. As there is no user with this name on the OTRS lists on Commons and meta, I would like to know the validity of the ticket. Use of Wikipedia Images on Published Material

Dear all,

I have a digital media agency and we are creating a facebook app that references famous people. It is editorial but funded by a brand. Having read as much as I can on here I believe that I can use images on Wikipedia as long as I reference the image in the manner specified by the owner.

This line seems to confirm this:

attribution – You must attribute the work in the manner specified by the author or licensor (but not in any way that suggests that they endorse you or your use of the work).

1) Is the above true? 2) Most images don't seem to have a specified means of attribution?

Can anyone clear this up?

I have too many images required to contact individuals directly but am happy to credit where needed if I only knew how?

I have to say yes and no or better: depends.
If you click on an image then you get to a description page that shows under which license the picture is released. If the image is stored here at Commons, then it is released under a free license meaning that you can use them, but have to mention mostly the original author (e.g. when released under CC-BY), but that depends on the license/image. Most image description pages also have in the "license box" a link to the original text of the license text - sometimes (e.g. if released under Creative Commons) these pages explain what are you allowed (and what not) easier than here. mabdul 14:15, 6 January 2012 (UTC)

I used an online translator to get the gist, but I don't feel comfortable answering it with a machine translated form of French. If a French speaking OTRS agent could get it that'd be awesome. Sent an OTRS in claiming that they are the photographer, however, after a bit of research I'm not so sure. The text in the email was I hereby confirm the International Baseball Federation's full permission to use the content in question, as we consider Wikipedia an important medium that serves as a valuable reference. and this came from ibaf's official email id. Someone who speaks Romanian should check the ticket to see if it applies only to the text of the book or also to the photos published in it (which may be taken by various authors). I am in the process of publishing a scholarly book with a university press and would like to have permission to reproduce the photograph of Tracy Markiniak Seavers and Zachary posted on Wikipedia (http://en.wikipedia.org/wiki/File:TracyAndZachariahAtFuneral.jpg).

According to image notes, it has been cleared for use by OTRS (permission is available for viewing in ticket #2011070710016553, which I don't have access to).

Can you please forward me th e permission ticket (preferably to my email address) so that I can investigate whether or not this permission extends to republishing in a book?

The email is in the permissions-commons queue where there is a backlog of around 20 days (ticket # 2012012310011411) and this one has been waiting for less than 4 days. I see now that there is Category:Photorail.com, on top of which it is claimed that pictures from www.photorail.com are licensed under the cc-by-sa-2.0, with the OTRS ticket as reference. the claim by the user is incorrect, at least inasmuch as it refers to the ticket. it is stated in the ticket (a forwarded correspondence from 2007) that 1) all images used on wikipedia and 2) created by Mr. Paolini 3) may be used commercially and derivative works may be created (verbatim: "RINUNCIO alle clausole NON COMMERCIALE e NON DERIVATIVA relative alle mie immagini utilizzate su Wikipedia"). i fail to see where the author agrees to cc-by-sa; or are the images on photorail.com somehow licensed under another cc license (couldn't find any.)? anyway, File:Tram ATAC 7031.jpg is obviously not covered by the ticket, and i'll also remove the otrs template from the category page for now. —Pill (talk) 22:09, 22 January 2012 (UTC)

Just a few words, since I have not much time for wiki projects, and frankly I'm long fed up with this kind of discussions on Commons.
Photorail is a community, owned and created by mr. Paolini. His images (and other authors too) were licensed as CC-BY-SA-NC-ND in a first agreement (most of them were so on the original website, too), then emended by dropping the NC-ND clause when WMF asked the projects to prefer free images. Yes, with "the page photorail.com" we were talking about the whole archive of mr. Paolini, not just a set.
The agreement cited by Pill is the second one, there is an older one (you can find a link on a page on it.wiki where all the agreements are listed). Please mind that Paolini, as allowed by the CC license, chose to have the BY clause executed by using a watermark on the image. It's in the powers of the licenser to chose the method used to display attribution, and he was very clear in his intention. According to CCs, even if the photos allow derivatives, removing the watermark is an infringement on the BY clause, thus a copyright violation.
Those images are NOT PD-Italy, since the presence of a watermark explicitly excludes the public domain after only 20 years (that's why he requested that as a mandatory clause, I guess).

Sorry, restrictions along the lines of this image can be used on Commons only if the watermark is kept is not the same thing as a free release and amounts to a no derivatives constraint. Commons contributors are unlikely to respect watermarks and the consensus view is expressed by the proposed policy at Commons:Watermarks and the consensus at Commons:Deletion requests/Template:CC-Dont-Remove Watermark. The OTRS ticket is valid and it came from Mark Remelb itself. The OTRS tickets were added in English Wikipedia probably by an OTRS volunteer but the source file history is not available now since the file was deleted from there. Ticket:2009031910074613 is indeed connected with these two pictures but I do not think that we can keep the two files on this ground. Firstly, an exact license is nowhere refered to. I find just a rather vague reference to either CC-BY or CC-BY-SA without any version, without any link to the licenses, and without any explanations what they mean. Secondly, there is a reference to Wikipedia only and it does not become clear that the copyright holder knew exactly what a release according to CC-BY or CC-BY-SA entitles. No attempt has been made to convince the Flickr user to put this picture under a free license at Flickr. Given that neither of the two pictures in currently used, I decided to delete them. PermissionOTRS

Hoi fellow OTRS volunteers, I'd recommend to remove "please contact someone with an OTRS account" from Template:PermissionOTRS and instead only refer to this page. If someone knows someone with OTRS access, she won't need a hint to the list, and if someone doesn't know anyone with access beforehand, picking a random person from the list seems to be a particularly inefficient (and ineffective) way to get confirmation. Permission has to be from the photographer since the creative commons licenses are legally binding contracts. If the photographer does not have an email account they can sign a form granting permission and have someone else scan it and email it to permissions-commons@wikimedia.org. Most users will usually let that go; even one of the Wikimedia Foundation bigwigs uploaded a photo taken by a friend. So a lot of people will ignore it; but for technical and legal reasons, we really should get the signature. I wanted to ask an OTRS person to take a look at the permission for File:Fay Kleinman.JPG. My concern is whether we have a permission only for the photograph itself (from the photographer), or whether we also have permission from the artist (Fay Kleinman) for her self-portrait which forms a prominent part of this photograph. If we don't have permission for the self-portrait also, I'm thinking this should be cropped more closely around Ms. Kleinman (and then delete the current version from file history?) to ensure that any non-free content is de minimis. What's the best way to handle this? Certainly it can be cropped to reduce the copyrighted content to a de minimis level (a crop just above her head cuts of most of the painting behind her and a crop just left of her elbow cuts off most of the self-portrait. It apparently covers File:Dabney-Green House.png and a lot of similar images uploaded by User:Dudemanfellabra originating from the Mississippi Department of Archives and History. There are a few later uploads by the same user (e.g. File:Lacy Homestead.jpg) and a lot of uploads by User:Woodlot (e.g. File:Suttle Building.jpg) which do not have any OTRS marking. Does the ticket give a general permission for all images from the Mississippi Department of Archives and History (so that all of the unmarked images are covered), or should the images without the OTRS ticket be deleted? --Stefan4 (talk) 20:24, 16 February 2012 (UTC)

Oh my. You wouldn't give us a nice easy one to look at would you? This is a bit complicated, and if I was the agent handling the ticket, I would have asked for clarification before confirming OTRS permission for the images. The ticket is forwarded correspondence with a representative of the Mississippi Department of Archives and History, who says that the MDAH owns the copyright for all the images on their website, but then goes on to say that some images were taken by a contractor. They also say (paraphrasing) that the images can be used provided proper attribution is given, but then that the images are "public record" (which they seem to be conflating with public domain). Explicitly mentioned in the ticket are File:Carnegie Library Meridian, Mississippi.png, File:Dial House.png, and File:Masonic Temple Meridian, Mississippi.png, but interestingly, none of those images have a license. Since none is specified (by the MDAH representative) in the OTRS ticket, and it's not clear who exactly owns the copyrights, I'm going to have to say that the ticket isn't valid. We need clarification on who the copyright holders are, and which license, if any, they're willing to grant. That said, I'd appreciate appreciate a second opinion from another experienced OTRS agent. HJM - second opinion - After reading through the email, I suggest a polite email back to MDAH and the original requester for a clearer statement in addition to the good faith attempt to originally provide a free release for some of this material. Public record ≠ Public domain, however it may well be that this particular government agency might have a policy to release material of this type or maybe they are obliged to review each image before release. I doubt there is any urgent need to delete these images from view but I suspect that MDAH would probably reply fairly quickly if emailed at the address specified at http://mdah.state.ms.us/admin/contact.html in the meantime I would consider these images as in an "OTRS pending" state and perhaps should be tagged as such. Just a note: before finding a file with the OTRS ticket, I tagged a lot of MDAH files with {{No permission since}} (and equivalent on English Wikipedia) and for that reason, there are a lot of MDAH photos in Category:Media missing permission as of 16 February 2012. Most of the black and white photos in that category are from MDAH, and I think that it might also affect a few colour images. Shall I replace "no permission" with "OTRS pending" for the whole lot of them? --Stefan4 (talk) 22:42, 16 February 2012 (UTC)

Deep Blue

Please could you check the licensing position with regard to this site. I forwarded an email on 16th February from the owner of the site granting a Creative Commons Attribution-ShareAlike 3.0 license for use of the images on his site. The attachment is the standard boilerplate CC-By-SA release (in English), which says all the right things. The trouble is that the email is from a free webmail account, so we have no way of knowing (based on that email) that they are who they say they are. Wikimedia is a cool site, but very confusing for those of us who are casual users. I'm trying to get permission to use a photo with the ticket# https://ticket.wikimedia.org/otrs/index.pl?Action=AgentTicketZoom&TicketNumber=2011082410005987. I'm not an OTRS member, whatever the heck that is. Just want to use that photo in a brochure.

Procedure for permission

I've been working lately on a lot of articles regarding Politics in Puerto Rico, and I wanted to know what would be the proper procedure to get a release/permission to use official pictures of local politicians (senators/representatives) taken from the official government websites (Senate of Puerto Rico and Puerto Rico House of Representatives) mostly on their respective infoboxes. I was told that similar permissions have been granted to similar cases of politicians pics taken from official government websites. Any help on how to do this will be appreciated. Anything by the US Federal Government is in the public domain. Anything by local governments is, I believe, up to the state/county/unincorporated territory/etc. If there is no blanket release of images by the Puerto Rican government, you'll have to contact them and ask if they will release the images you want under a CC-By-SA license or compatible (then forward their reply, if you're successful, to permissions-commons@wikimedia.org). I wouldn't worry too much after only five days—there are several hundred emails, some several weeks old, in the permissions-commons queue.
